Terms of Use

By registering for SurfNet Corporation’s services, you agree to abide by these Terms of Use. Our goal is to ensure that all customers use our services responsibly, respecting the rights of other users and maintaining the integrity of our network. (Note: Items marked with an asterisk (*) do not apply to Dedicated Server customers.)


1. Lawful Use

SurfNet Corporation’s servers are to be used solely for lawful purposes. You are prohibited from transmitting, storing, or distributing any data or materials that violate any applicable law or regulation, or that may facilitate such violations. This includes, but is not limited to, unauthorized use of copyrighted material, trademarks, trade secrets, or any intellectual property; content that is obscene, defamatory, or poses an illegal threat; and materials that breach export control laws. Prohibited examples include pirated software, hacker tools or archives, Warez sites, unauthorized MP3 sharing, and IRC bots.


2. Indemnification

You agree to indemnify, defend, and hold harmless SurfNet Corporation—including its parent, subsidiaries, affiliates, third-party service providers, and their respective officers, directors, employees, and agents—from any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorney fees) arising from:

  • Your use of our services;
  • Any violation of SurfNet Corporation’s policies;
  • Any breach of your representations, warranties, or obligations under these Terms; or
  • Any actions or omissions on your part.

This obligation will survive the termination of your account or these Terms. For the purposes of this section, “you” includes your end users, website visitors, and users of any products or services that you offer, which are facilitated by us.


3. Disclaimer of Warranty

SurfNet Corporation DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, including without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Our services are provided “as is” and “as available.” We do not guarantee that our services will meet your requirements, be uninterrupted, timely, secure, or error-free, nor do we guarantee that any defects will be corrected. No oral or written information provided by SurfNet Corporation or its representatives will create any warranty. SurfNet Corporation and its partners will not be liable for any damages arising from the use of our services. (Some jurisdictions do not permit the disclaimer of implied warranties, so this limitation may not apply to you.)


4. Security

Any attempt to compromise system or network security is strictly prohibited and may result in both criminal and civil penalties. Prohibited actions include, but are not limited to, unauthorized access, probing, scanning, or tampering with security measures, data, or network traffic; interfering with service through mail bombing, flooding, or other means; and forging TCP/IP headers or related information in emails or newsgroup posts.


5. Unsolicited Email (SPAM)

The sending of unsolicited bulk emails (SPAM) using a SurfNet Corporation server or any email address hosted on our platform is strictly prohibited. This prohibition applies even if you use another provider’s service but reference a website hosted with us, or if you distribute software that facilitates spamming. Violators will incur a minimum fine of $500 and may have their account suspended immediately.


6. Server Abuse

Any attempts to damage or disrupt SurfNet Corporation servers, or to harm other customers, are strictly forbidden.


7. Software Distribution*

SurfNet Corporation’s shared hosting accounts (non-eCommerce) are not intended for distributing software or multimedia products. If you wish to distribute such files, please contact sales@surfmail.net for special arrangements.


8. Copyright Infringement

Under the Digital Millennium Copyright Act (DMCA), you may notify SurfNet Corporation of copyright infringement. To do so, please send your notice to our designated agent via one of the following methods:

  • Mail/Courier: SurfNet Corporation, Attention: Abuse, 951 N. Plum Grove Rd., Suite B, Schaumburg, IL 60173

Your notification must include:

  • A physical or electronic signature of the copyright owner or an authorized representative;
  • Identification of the copyrighted work(s) claimed to have been infringed;
  • Identification of the infringing material with sufficient information to locate it;
  • Your name, address, and telephone number;
  • A statement of your good faith belief that the disputed use is not authorized; and
  • A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner.

9. Enforcement and Remedies

Failure to comply with these Terms of Use may result in immediate account deactivation. When a potential violation is detected, SurfNet Corporation will investigate and may restrict, suspend, or terminate your account at our sole discretion. In cases involving criminal activity, we will also notify law enforcement. No service credits will be provided for outages resulting from actions taken due to violations of these Terms.


10. Repeat Infringer Policy

If a customer receives three credible, repeated copyright infringement notices, SurfNet Corporation will immediately terminate that customer’s account without prior warning. All content associated with the account will be blocked or deleted. By using our services, you agree to this policy and release SurfNet Corporation from any claims arising from its enforcement.


11. Modification of Terms

SurfNet Corporation reserves the right to add, remove, or modify any provision of these Terms of Use at any time. We will notify customers of any significant changes, at which point you may choose to terminate your service if you do not agree with the updated terms.
