SurfNet Corporation Acceptable Use Policy

At SurfNet Corporation, we provide Internet access, website hosting, and a range of Internet-related services to our customers and their end users. Our services empower users to acquire and share public, private, commercial, and non-commercial information. While we recognize and support the Internet as a forum for free and open discussion, we also must balance competing interests by taking preventative or corrective actions when necessary.

This Acceptable Use Policy (“AUP”) supplements your service agreement with SurfNet Corporation and serves as a guide to your rights and obligations when using our services. Please note that this policy may be updated periodically. Your continued use of SurfNet’s services after any changes are posted on our website (www.surfnetcorp.com) constitutes your acceptance of the updated AUP.


General Principles

  • Open Internet, Shared Responsibility:
    The Internet’s openness is one of its greatest strengths. However, with that freedom comes responsibility. Users must exercise sound judgment both in the information they acquire and in the content they disseminate.

  • No Monitoring Guarantee:
    While SurfNet does not actively monitor or censor Internet communications, we cannot verify or warrant the accuracy or quality of information obtained from third parties. Consequently, you should exercise caution and discretion in relying on such information.

  • Liability for Your Content:
    When you publish or share information using SurfNet’s services, you are solely responsible for your content. This includes any copyright infringement, defamation, or other harmful speech for which you may be held liable.


Prohibited Activities

Subscribers (or their customers, affiliates, or subsidiaries) violate this AUP—and their service agreements—if they engage in any of the following:

  • Spamming:
    Sending unsolicited bulk or commercial messages is strictly prohibited. Spamming not only degrades consumer trust but also can overload our network and disrupt service. Maintaining an open SMTP relay is also forbidden. SurfNet will evaluate all complaints to determine if messages were sent from an “opt-in” list.

  • Intellectual Property Violations:
    Any activity that infringes or misappropriates the intellectual property rights of others—including copyrights, trademarks, trade secrets, software piracy, or patents—is prohibited. This also covers actions that violate the privacy or publicity rights of others. Repeat infringement may result in termination of services.

  • Obscene or Harmful Content:
    Using our network to transmit, store, or display child pornography or obscene material is unlawful. We are legally required to notify law enforcement if such material is detected.

  • Defamatory or Abusive Language:
    Transmitting or posting content that is defamatory, harassing, abusive, or threatening is not permitted.

  • Header Forgery:
    Misrepresenting message headers, in whole or in part, to conceal the origin of a message is prohibited.

  • Unauthorized Access:
    Accessing or attempting to access computers, accounts, or networks without authorization (commonly referred to as “hacking”) is strictly forbidden. This also includes activities such as port scanning or other preparatory information gathering.

  • Distribution of Malicious Software:
    Distributing viruses, worms, Trojan horses, or any other malicious code, as well as instructions for their creation or propagation (including activities like flooding, mailbombing, or denial-of-service attacks), is prohibited.

  • Facilitating Violations:
    Advertising or distributing software, programs, or services designed to facilitate any of the above violations—including spamming, denial-of-service attacks, or piracy—is not allowed.

  • Export Control Violations:
    Exporting encryption software or other restricted materials to locations outside the United States in violation of applicable laws is prohibited.

  • Usenet and Newsgroups:
    SurfNet reserves the right to refuse postings from newsgroups if we have knowledge that the content violates this AUP.

  • Other Illegal or Harmful Activities:
    Engaging in any activity that SurfNet determines to be illegal or harmful to our subscribers, operations, reputation, goodwill, or customer relations is strictly forbidden. This includes, but is not limited to, activities such as Ponzi schemes, pyramid schemes, fraudulent credit card charges, and software piracy.


Enforcement and Cooperation

SurfNet Corporation reserves the right to take any corrective or preventive measures—including removal of content, suspension or termination of accounts, or denial of access—to address any violations of this AUP. In addition, we expect that subscribers who offer Internet services will cooperate with any corrective measures deemed necessary by SurfNet. Failure to cooperate may result in additional sanctions.


Liability and Indemnification

By signing your service agreement with SurfNet Corporation, you agree to indemnify and hold harmless SurfNet and its affiliates, employees, and agents from any claims, damages, or losses arising from your or your customers’ violations of this AUP or applicable law.
